1. Scope & Definitions

These Terms govern the sale of goods to:

• Consumers (B2C): Individuals purchasing for private use under Decree-Law no. 24/2014 and Decree-Law no. 84/2021.

• Business Customers (B2B): Entities identified by a corporate NIF purchasing for resale or professional use, governed strictly by the Portuguese Commercial Code.

2. PRODUCT CLASSIFICATION & SAFETY

• PPE Classification: These solar glasses are classified as Category I Personal Protective Equipment (PPE).

• Compliance: Products are certified to meet the ISO 12312-2:2015 standard. 

• User Obligations: Users must inspect the filters immediately upon receipt. Use of a scratched, punctured, or detached filter is strictly prohibited.

• Liability: The seller is not liable for ocular damage resulting from:

  1. Use with secondary optics (telescopes, cameras, binoculars).  

  2. Lack of adult supervision.

  3. Use of the product after the integrity of the filter has been compromised by the user. 

  4. Not using according to the intended use or not following the instructions.

  5. Only the Lens Filters can be used with telescopes, cameras, binoculars according to the specific instructions.

3. PRICING & THE "LOWEST PRICE" RULE

• VAT: Prices include Portuguese VAT (23%) unless a valid VIES VAT exemption is verified for B2B.

• Transparency: In accordance with DL 109-G/2021, any displayed discounts are calculated based on the lowest price practiced by this store in the 30 days prior to the promotion.

4. B2B & WHOLESALE SPECIFICITIES

• No Statutory Withdrawal: B2B transactions are final. There is no "cooling-off" period.

• Transfer of Risk: For B2B, risk passes to the buyer upon delivery to the carrier (FCA/Ex Works).

• Invoicing: All B2B invoices are issued with a Qualified Electronic Signature (QES) for fiscal validity.

 

5. WARRANTY

• Consumers: 3-year legal warranty (DL 84/2021). In the 3rd year, the burden of proof rests with the consumer.

• Businesses: 6-month warranty against manufacturing defects (Commercial Code).

• Exclusions: Warranty does not cover humidity damage, frame creases, or film scratches occurring after delivery.

 

6. DISPUTE RESOLUTION

• Complaints: Livro de Reclamações Eletrónico.

• Arbitration: Consumers may resort to CICAP (Rua Damião de Góis, 31, Loja 6, 4050-225 Porto).
